Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the EverRock platform, website and related services (the “Service”) provided by EverRock (“EverRock”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you are accepting on behalf of a preschool or organization, you confirm you are authorized to do so.

1. The Service

EverRock is preschool management software for managing attendance, daily reports, fee collection, transport and activity billing, staff and parent communication across one or more branches. We may add, change or remove features to improve the Service.

2. Eligibility & accounts

You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for all activity that occurs under your account and for the actions of staff you invite to use it.

3. Plans, billing & payments

  • EverRock is offered on subscription plans priced per branch, billed monthly or annually, with no setup fee.
  • Paid plans include unlimited children and the messaging quotas stated for each plan.
  • A free trial may be offered; at the end of the trial, continued use requires a paid plan.
  • Fees are exclusive of applicable taxes unless stated otherwise.
  • You may cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.

4. Messaging quotas

Each plan includes WhatsApp and SMS allowances. If you reach your quota, you may top up or upgrade your plan to continue sending messages. Messaging is also subject to the rules of the underlying WhatsApp and SMS providers, and you agree to use it only for legitimate communication with your enrolled families and staff.

5. Your data & responsibilities

You retain ownership of the data you enter into EverRock (“Customer Data”). You are responsible for the accuracy of that data and for obtaining any consents required from parents, guardians and staff before adding their information or sending them messages. You agree to use the Service in compliance with applicable laws.

6. Acceptable use

You agree not to misuse the Service, including by attempting to access it without authorization, disrupting its operation, reverse-engineering it, uploading malicious code, or using it to send unlawful, harmful or unsolicited communications.

7. Intellectual property

The Service, including its software, design and content (excluding Customer Data), is owned by EverRock and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You may not copy, resell or create derivative works from the Service.

8. Service availability & support

We work to keep the Service available and reliable, and provide support to active subscribers. The Service may occasionally be unavailable for maintenance or factors beyond our control. We aim to give notice of planned maintenance where practical.

9. Suspension & termination

We may suspend or terminate access if you breach these Terms or fail to pay applicable fees. You may stop using the Service and cancel your subscription at any time. On termination, you may request export of your Customer Data within a reasonable period, after which it may be deleted.

10. Disclaimers

The Service is provided on an “as is” and “as available” basis, without warranties of any kind to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free.

11. Limitation of liability

To the maximum extent permitted by law, EverRock will not be liable for indirect, incidental or consequential damages, or for loss of data, revenue or profits. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

12. Indemnification

You agree to indemnify and hold EverRock harmless from claims arising out of your Customer Data, your use of the Service, or your breach of these Terms.

13. Changes to the Service & Terms

We may update these Terms from time to time. We will post the revised Terms here with a new “Last updated” date, and continued use of the Service after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of India, and the courts at Chennai, Tamil Nadu shall have exclusive jurisdiction over any disputes, subject to applicable law.
